It will be in trouble when registering a trademark or a brand name ?

    If you deliberately trade off the goodwill of a third party, you will likely lose the domain. To familiarise yourself with the legal issues involved, you may want to read up on some INDRP cases.

    In response to your specific examples:

    If you use Gap.in in association with clothing, you'd risk losing the domain to Gap (Apparel) Inc. See cases involving Gap: DomainFight.net

    If you use Gap.in a completely different area of business than clothing, the domain should be safe.

    Be aware of exceptions with regard to well-known trademarks.

    I can't see any reason for your using this domain name, other than to trade off the goodwill of J Crew Inc. I think you'd likely lose this domain in an INDRP case.
