CEAT Limited of India filed a complaint against the Hong Kong based registrant of the domain Ceate.com and was taken through the UDRP process at the WIPO.
The Indian Complainant, CEAT Limited of Mumbai, India, asserted that their mark for CEAT is famous.
The panel delivered a finding favoring the Respondent:
“The Panel notes that the Complaint is very weak and that the Complainant, being represented in this case, should have known that it could not demonstrate that the Respondent registered and used the disputed domain name in bad faith.”
