Imagine coming up with “pizzarita” – a creative domain name and brand – in 2001, and being challenged by some company 18 years later.
That’s exactly what happened with the domain Pizzarita.com, with Jeffrey Marrone LLC DBA “Pizza Rita” being the Complainant in a UDRP.
The Pizzarita.com owners are using it as a forward to RollingInDoughPizza.com, and did not respond to the UDRP filing.
Lack of response does not indicate a loss for the Respondent is guaranteed, as other parameters are in play.
In the case of Pizzarita.com, John J. Upchurch, Panelist at the National Arbitration Forum, noted that the domain was registered 14 years before the Complainant made any use of the domain on a food truck.
