The Complainant is a beverages company based in Scotland. It has owned the trademark CAPTAIN MORGAN in India since 1996 (and related trademarks earlier than this). It also owns the domain CaptainMorgan.in.
Two years after the Complainant registered the .in domain, the Respondent registered CaptainMorgan.co.in.
The Respondent claimed he had planned to create a tribute site on Admiral Sir Henry Morgan (who was called Captain Morgan). However, the Respondent did nothing with the site during the 1?-year period since he had registered the site.
The Arbitrator stated that the Respondent failed to establish any rights to the words Captain Morgan, and also failed to demonstrate preparations in respect of launching the website.
The Respondent was ordered to transfer the domain to the beverages company. No surprises here.
