Huawei Wins Huawei.in For a Second Time

Huawei, the well-known telecommunications provider, won the domain Huawei.in for the second time.

Huawei first won the domain in February 2008 in an INDRP case. However, it later forgot to renew this domain and a third party then registered this domain.

It sent a legal notice to the new owner but received no response. Huawei therefore took it to INDRP arbitration (for the second time).

Huawei owns a trademark in India for HUAWEI, which was registered before the domain registration(s). It has similar trademarks worldwide.

The respondent did not reply to the complaint.

As Huawei is not a generic word, and the respondent did not file a response to show that they had a legitimate connection to word "Huawei," I think the Arbitrator was correct to order the transfer of the domain.

The Arbitrator also ordered the respondent to pay Huawei an amount of Rs. 5,00,000 towards the costs of the proceedings. That's a lot of money - approx. USD $10,000.

Coincidentally, in April 2008, Huawei also won Huawei.co.in. On checking Whois, I'm glad to see Huawei were smart enough to register this domain for 10 years!
