Who knows looks like United Pharma has a medicine by the name, not sure who would file an INDRP for this. This should be interesting given the COM is on sale by a brand marketplace.

So are dot INs so sought after that anyone files one for anything? Should there not be a minimum threshold or criteria?

The country of origin seems to be from India: http://www.unitedpharmacies.com/Zifi-Cefixime.html , hence the INDRP.
 
"Country of origin" is not a basis for INDRP. United happens to be a online pharma store, just realized they are not the same as United Pharma.

The manufacturer FDC does own 3 TMs in class 5 for ZIFI, ZIFI 200 and ZIFI 100 DT. since 2003 applied for in 2001.

However registrant has not used what I consider to be an Acronym (ZIFI) based name in violation of the policies nor has he parked it for profit. So having a TM in a class should not offer default ownership rights. The registrant has a right to create a business named ZIFI or a service offering say for the next WIFI technology called ZIFI - all speculative of course.

We do not yet know who has filed this...guess would be FDC.

If it is them specifically then akin to others, the argument under WIPO laws could mean they could go after the COM as well.
