Legality issues of posting names for sale on Sedo and other auctions sites??

How many of you post your premium names from your portfolios on auction sites such as Sedo? I have had many conflicting responses from various guys in the industry in regards to the legality issues involved in parking .in domain names and also in relation to putting them up for sale on such sites too.

A few of the registrars have mentioned that using Sedo is illegal and one could risk their domains being taken away from them if they do put it for sale on an auction site, whereas other well known domainers do not seem very bothered about this legal issue and continue to park at Sedo and offer their names for sale on such sites.

Does anyone have more information in regards to this? Is it OK to put our names on Sedo?
 
As you may know I recently had a dedicated .co.in/ .in auction at Sedo.com.

Apparently this auction was discussed at length at the highest levels of the IN registry to determine whether or not to take any action if it contravened regulations.

Nothing happened,the auction went ahead and nothing was said before or after.

Despite any regulations there may be there have been hundreds of .co.in/.in auctions via many different platforms with Sedo.com being the most prominent.

I would assume that with so many precedents having been set it would be difficult for the IN registry to take any action without looking quite stupid so more likely to leave well alone.

BUT - They have the option.
 
Thanks for the reply wot, so what everyone seems to be saying is that in theory it is actually illegal although the registry is very unlikely to do anything about it? Therefore the risk lies with the domainer as to whether they wish to risk it or not. Would you risk a name that maybe valued close to $30,000 by putting it onto Sedo?

Any other opinions will much appreciated guys! I am sure many people on this forum will be interested in the answer to this one.
 
How would you value a name at $30,000? That would only be determined by a sale?

However,I would have no problem putting a perceived high valued name on any platform that would promote it,but more likely it would have to have big end user potential and as such I would be promoting it accordingly.

Do you think the Registry contacted Sedo with regards to your auction? If that were the case, maybe that could be the reason why the auction wasn't promoted at all by Sedo.

No,simply Sedo incompetence!
 
One could 'roughly' value a domain based on a previous offer of that price (e.g. $30,000). But regardless of this, back to my main question....it seems as if the answer is as previously thought, most people seem to know it is illegal to promote the sale of .in domains on Sedo and other auction sites yet most domineers are still doing it and risking legal action from the registry and potentially having their names taken away from them?

I am guessing the answer would be no.

A yes would indicate just about the end of .co.in/.in as a domainers resale business.

He says A can sue B in India and get the domain if he has more legitimate holding on the domain name ... Do you guys know if this is true ?

TBH, becoming a bit sick of the flimsiness of the Indian Govt constantly changing rules for ownership of .in domain and people losing domains...Now we have them blocking Sedo..
 
Anything can happen in what is a generally corrupt society.The .in registry has always looked a bit dodgy from day one and there have been numerous cases of domainers losing quality domains via the use of spurious weakTM's that were made simply to steal names.

Even when the .co.in/.in launch happened in 2005 there were all sorts of of dodgy happenings with certain registrars creaming off the best of the crop and allocating to their buddies.That sort of thing cannot happen without collusion from the highest authorities.

It's probably better now but not sure by how much.

it even happens with 99% of domains. .com/.co/.me/.tv and alike

there are a few really big players that have the buying power.
these guys are the ones that set up the landrush auctions and control release dates etc

they own the nic for the domain extension theyre selling.

its been like that since the birth of man....its commonly called a 'plutonomy'
simply meaning that 1% control and dictate what the 99% get.

this will never change as its human nature to help friends and family

now look at some .co domains on this list......its a shame they're selling cheap but its common

Wot, Good Point... Even for .in domains the bulk of the best domains is owned by a certain company...And like you mentioned it doesn't happen with the Collision of the higher authorities..

Blocking of Sedo is a very bad signal imo... Won't be suprised if these same guys collide together to snatch other high quality domains using shady methods..

Unfortunately i have invested several thousand dollars into .in domains and now have been getting only low ball offers for them...Bad place to be in

me too, spent thousands for a $100 return.
.co was worse

.mobi has a true horror story
flowers.mobi was purchased for $200,000
sold for $6,500.
then resold for $5,000 to 1-800 flowers

OUCH!

.com's are the best way to go, always have and will be the best domain investment

Yeah .com has been the best investment ..I've lost on .mobi and also a on .tv premium names

My real big fear is the Govt of India doing something drastic or passing some law that would push the value really down or cause mass panic..I'm tempted to offload my domains...but will lose several thousand $'s... Its become like gambling now...desperately trying to grab more low cost domains in the greed for recovering something....

I really dont know what will push the .in market up...

I wish I also knew that answer, i actually dumped 300+ .in domains.

the thing that keeps them down is registrars charging $1 for a .in. (they know who they are......short term profit is just that 'SHORT TERM')

the registrar is the ONLY person seeing a return, but its business and they have a strategy to make money at the expense of the market.

.in needs to be regulated like .com.au or very similar

i just found 'documentaries.in' was available

its a PRIME 1 word domain, but I feel its not a good investment which is a shame.........it honestly is

I think that's what has prevented the market from taking off. We can definitely say .IN is a risky and long term investment, however I'm confident for the future.

The funny thing is India along with China are both 'Super Heavy' weights and just the population would dictate things should be different.

kinda weird if you ask me that censorship is so dominant in India as It really does hurt society in general and is NOT progressive
if you have seen 10000's naked women before your 18? then its not that 'taboo' and really of zero interest to a 'healthy minded person'
if you hide it? then sexual assaults, rape etc will never drop in numbers

IMO I think the .in & .cn markets will be the largest in 10 years....a highly speculative comment I know but its a simple look at an 'educated population' that increases by the day
the reason why I say this is because the changing into a new generation will help with things along.

the Indian market has HUGE potential but until the registrars that are selling $1 .in domains stop doing so and look at the long term health of the market things are NEVER going to change.

then Sedo and others alike.
TBO sedo are basically a .de / .co.uk auction house now

Absolutely. If it hadn't been for InForum, probably I would have never started investing in .in.

The funny thing about the adult matter India and its excessively zelous censorship is that a high percentage of the adult-related searches worldwide on Google comes from India.

It's why in today's technological world censorship will never completely work. Prevent people from openly seeing what they want to see or do and they will find a way to do it under the table whether it be porn,gambling alcohol etc.

You can bet the majority of those advocating the use of censorship are more than likely the biggest abusers.

Just an aside.I had on occasion found myself working in Bahrain over some weekends. The holier than thou Saudis would pour across the causeway between the two countries to meet up with the Russian and Filipina ladies of the night and whore and booze the couple of days away in the hotels and then back to Saudi to take up whatever positions they occupied and return to their families-until the next time.

porn, booze, gambling and whats the bet that the some of the same politicians that make the laws are cross-dressers wearing womens underwear and shoes at night, hire young boys for sex or beat their wives.
