Opinion on .in Adult names & Ambiguity involved

Hello,

I just wanted to share my opinion on how I feel about .in and Adult/Porn related names.

1) I understand that online Adult/Porn Industry in India is publicly CONDEMNED by all major OFFICIALS in the Government starting right from the President, same sentiment exists in all major Political parties and their Leaders as well.

2) ".IN" Registry, if it condemns Adult/Porn names they should reserve the names and not leave them in Wild leaving room to wild speculation/confusion. Because the world we live in goes like this, if you don't register a Adult/Porn domain(or any domain for that matter) that is available then somebody will register it and quite possibly launch a porn website and create trouble and get into trouble. Why leave room for error and complications. Make a policy on it, STOP porn KEYWORDS from getting registered as domains, it is not difficult at all considering the available technology. Ambiguity and assuming PUBLIC will refrain themselves from registering problem domains is not a WISE thing to do. The world we live in is BIG and ".IN" names are made available world over. Yes PORN in India is not allowed. But can we think and assume that a Prospective domainer/developer somewhere in the world will think about legalities involved? no most of the time, because it never crossed the domainers mind that it is illegal to do so.

Then who is the culprit here? Domainer/developer in question or the Registry which left room for ambiguity and confusion? which can be prevented by making a specific rule and blocking PORN KEYWORDS.

If this world is a perfect place we will not have this many cases, disputes etc. So I feel nothing can be left in OPEN based on assumptions. We should look at what happened in other countries and take necessary actions. Just because ".IN" is available worldwide. There are so many measures taken world over to stop UNDERAGE KIDS from accessing the websites in question, parental controls, mentor ship and more. Internet is a BIG THING, if there are no specific rules or if there are no strict measures/enforcement it is impossible to get hold of the problem addressed.

In my case what I have done is I came across one adult name that is available to register, I registered it and kept it at "SERVER NOT FOUND" Status. If not me somebody else might have taken it. So I acted as a STOPPER registered the name and made it kind of USELESS.

So what happens to this name in future? If you ask me that question I will say, it just stays there and never sees light of the day until something is solid on the ".IN" registries end by either blocking porn keywords so that new domains can't be registered or suspending and deleting the existing names or both so that existing ones are gone and new ones can't be registered. If ".IN" registry opens up the segment then it is a different story.

Let's be honest in saying that Adult entertainment is nothing new, it cannot be eliminated from peoples lives however you try. Only thing one can do is accept it as it is or Condemn it in totality by taking necessary action. Adult entertainment is in our NATURE some take it easy, some want it etc. We have centuries(actually 1000's of years) of History behind it.

That said what is the origin of KAMASUTRA? where did it came from... What about the internet porn Industry that is flourishing based on one keyword DESI with suffix or prefix. In India it looks like it is OK if you enjoy adult entertainment privately, you will be Condemned if you do it publicly. It seems raw to me. We can do better here.

Government should understand, monitor the behavior of people(by polls/referendum) see where Indians are going when it comes to Adult Entertainment and take appropriate measures. Isn't government there for people? and by the people? India is a Democracy and even though there is considerable corruption, we always stand out. We excel and numbers show the progress, the real world data on India's Economy and it's Growth as a nation of people who are good at everything. Well Almost :)

I am sure there is work going on in this regard at highest levels in the Government/IN Registry. It is just a matter of time before something is written in STONE.

I applaud the people concerned who has made .IN available to the world and not just India. We are a democracy after all and I am very happy about it.

Please feel free to add in your opinions/comments.

Regards,
Nanda.

Since you correctly mentioned Kamasutra, my take is that adult entertainment in India is considered legal as long as sex is portrayed respectfully and in a positive light, while illegal if the topic is presented in a degrading and vulgar way.

Hello The_Poet,

I appreciate your view, you think it is legal. But if you look at Terms and Conditions for Registrants

Term 6 states:
6. .IN Registry considers illegal or fraudulent actions, spamming,
using email in denial-of-service attacks, Phishing, Pharming,
Botnet command and control, Distribution of pornography, Illegal
Access to other computer and networks etc. as abusive use of
domain name. Registry can suspend the Registered name in such
cases and initiate action accordingly. Further, Fast Flux hosting
may be used only with prior permission of .IN Registry.

So now from what I understand, Registry is not saying you cannot register adult/porn domains. It only clearly says "Distribution of pornography" is not allowed. There is no respectful pornography or disrespectful pornography, there is only pornography.

It looks like Registry expects Registrants to be SELF GOVERNING and not Distribute pornography, if you do then you will loose your domain name. There is no ambiguity here.

Only ambiguity is we are not reading properly and the registry allowing everyone to register adult/porn names but disallowing related web development.

I am not sure exactly why registration of Adult names is allowed, I think it is because in future there will be LAWS made to allow Adult Entertainment in .IN cyberspace. Only other scenario I can come up with is at one point they will not renew the existing adult names and disallow new registrations.

They left this room, may be to wait and see where India as a Nation stands when it comes to Adult Entertainment and then decide.

Regards,
Nanda.

@nametrader

IMHO they think pornography is a disrespectful representation of sexuality, that's why adult domains are not forbidden. What counts is how you use the domain so I suppose it's a case-by-case decision.

@ The_Poet, nobody is naive to register a porn domain for other purposes, so basically stay away from development as no one can use a porn domain for any other purpose other than "No Porn here".

I agree with the first part yes.

You could always develop an artistic website rather than a pornographic one. A painting of a naked woman is art, a picture of a pornographic actress dressed and made up vulgarly (not necessarily having sex) is porn.

Sold most of the more obvious ones I had to ensure no ongoing problems though still a few minor names.

Fortunately not like .cn where if you are using .cn for porn you can lose ALL of your names!

The minor names:

Hardcore.co.in

Anime.co.in

BDSM.co.in

Lesbian.co.in

Manga.co.in

SexBlog.co.in

Naked.co.in

@ The_Poet, Excellent be an example make a site on a porn domain like you suggest. Then we will all see what will happen to your .in porn name.

@Wot yes I think India will follow the West in near future and pornographic laws will be made. When you look at term no 6 above the names you posted should not be having content they have, because by clicking those links people get connected to porn sites and it becomes "Distribution of Pornography" in the EYES of the LAW. They are alive resolving and kicking :)

This is the ambiguity that a normal person has with .in adult names.

What @The_poet mentioned is also a valid point, Naked pictures of Women in ART form is always appreciated as art by everyone. Even I don't see anything wrong with it.

Thanks for stopping by.

That's those very naughty Sedo people,I know nothing. ;)

And I agree, beautiful women and I suppose even men posing in the right way can be an art form.

FYI I don't own any adult-related .INs. I was just suggesting alternative ways to develop such names if you'd like to, I was not saying I own them.

Hi @The_Poet good morning :) I was Kidding! thanks. Appreciate your opinion It was all Chaos in my brain until yesterday. The Naked ART stuff you brought up to the table is amazing. Opens great possibilities for those who do have adult names, I have one like I said .com version of it was sold for 500 grand!

I normally have my own mindset when I register domains. Once up on a time I went to Domaining dot com and looked at their TOP SALES page, I picked up all those domains and looked for their ".IN" cousins! found 2 one is Hipoteca and the other is this Porn thing, I registered it with the intent of killing it 1st then wait and see what future holds.

@Jeff, Thanks for your input, yes lesbian.co.in can be a great informational and educational site for the people into it and lots of other things.
