    Default Einstein.in Dispute

    The Yeshiva University has been awarded the domain name Einstein.in. You can read the decision here.

    The domain Einstein.in was originally registered in January 2009 but then it was dropped and re-registered around March 2010 (it's surprising that the University didn't register the domain when it became available). The University has a pending TM application in India for EINSTEIN & Design which was filed in September 2009. It also owns Einstein-related TMs in the United States.

    In 2002, a related institution of the complainant tried getting the domain AlbertEinstein.com but the complaint was denied.

    The Arbitrator had this comment to make with regard to incomplete Whois details:

    Before concluding, I would like to add that the registrant has given his address only as"503 Room, New Delhi and mobile telephone number as 91.12345678". How a domain could be registered by the Directi Internet Solutions Pvt. Ltd., the Registrars with these particulars. This requires investigation and appropriate action by the competent authorities.

    But the whois still shows old Respondent's name and the price on sedo has been upped from 3000 to 3500 ! This did not yet get transferred ?

    Due to the dispute, the domain has likely been locked by the registrar. The respondent wouldn't be able transfer the domain to anyone other than the complainant.

    I don't know if there's a time limit for the respondent to comply - does anyone know? In any event, in this type of situation it can take a while for the domain to be transferred and for the whois to be updated.
