INDRP: ArmaniExchange.in & Eurocopter.in
In two separate INDRP cases, both ArmaniExchange.in and Eurocopter.in were ordered to be transferred to the respective complainants. They seemed like straightforward cases to me.
With regard to the ArmaniExchange.in case, the complainant owns many ARMANI trademarks in India, including "A / X ARMANI EXCHANGE" which is one of the Armani brands.
The respondent did not file an official response but sent an email stating it was ready to transfer the domain to the complainant "upon compensation." The Arbitrator reminded the respondent that the proceedings can be terminated only on communication that a settlement has been reached between the parties. The Arbitrator did not hear any further from the respondent. In any event, in my opinion, the complainant had a strong case. FYI, the complainant also won Armani.co.in in a previous INDRP case.
With regard to the Eurocopter.in the complainant is one of the world's leading helicopter manufacturers and it owns a trademark in India for EUROCOPTER. The respondent did not file a response to the complaint.Last edited by Ceres; 02-11-2010 at 01:06 AM. Reason: Fixed broken links.
